The striking similarities between Nike?s Flyknit sneakers and the adidas Primeknit model are enough to cause comparisons, but are they enough for a lawsuit? Recently, the District Court in Nuremberg, Germany granted Nike?s application for interim injunction for patent infringement by adidas on the Primeknit sneaker. Because of this, adidas has been ordered to stop the manufacturing and distribution of the Primeknit in Germany.

While the surface level similarities are enough to imply likeness, they?re not enough to close the case. In order for Primeknit production to halt indefinitely, Nike?s wish in seeking a permanent injunction, there must be patent infringement in the production process.
